Terms of service

These general terms and conditions of sale govern the contractual relationship between Société eP (hereinafter referred to as “We”), which publishes the www.hopono-shop.com website, and its customer (hereinafter referred to as “You”).

These general terms and conditions apply to all supplies and services provided by us, unless otherwise agreed in writing by the parties and without prejudice to any special terms and conditions agreed separately. They take precedence over the customer's conditions of purchase, which are only binding on us if expressly accepted by us in writing.

In order to be enforceable, a total or partial non-application of the present general terms and conditions must be explicitly and precisely mentioned in the order form. An explicit and precise special condition on the order form shall prevail over any general condition to the contrary.

Consequently, the act of purchasing a product offered for sale on the www.hopono-shop.com website implies full acceptance of these terms and conditions of sale, which the Buyer acknowledges having read prior to purchase.

 

Article 1 - Orders

Prices are quoted in euros, inclusive of all taxes but excluding postage and packing.


All orders, whatever their origin, are payable in euros at the time of ordering.
We reserve the right to modify prices at any time, but products will be invoiced on the basis of the rates in force at the time of order entry.

Once you have placed your order, we will acknowledge receipt by sending you an order confirmation e-mail containing a summary of your order.
We cannot be held responsible for any errors in our offers.
Products remain our property until full and final payment has been received.



Specific rules concerning multiple purchases:

For orders of 10 items or more, it is imperative to contact our customer service department at contact@hopono-shop.com in order to obtain a suitable offer. Failure to do so may result in your order being cancelled.


A purchase limitation rule is in force on our online store for the following brands:

  • Jellycat
  • Legami

For Jellycat: we limit the purchase of plush toys to a MAXIMUM of 2 per customer. Any order of more than 2 will be refunded. Please contact us for any special requests.

For Legami: we limit the purchase of erasable pens to a MAXIMUM of 10 per customer. Orders of more than 10 will be refunded. Please do not hesitate to contact us for any special request.


Article 2 - Terms of payment

Article 3 - Shipping and delivery

The delivery times indicated on the site take into account the time required to prepare, dispatch and deliver the parcel. We make every effort to meet these deadlines.


Article 4 - Customs duties

Any order placed on the Site and delivered outside a country of the European Union may be subject to possible taxes and customs duties which are imposed when the parcel reaches its destination. These customs duties and taxes are the responsibility of the customer.

We are not obliged to check and inform you of applicable customs duties and taxes. We advise you to check with the relevant authorities in your country.

 

 

Article 5 - Right of withdrawal and return

We grant you the right to return items within 15 days without giving any reason.


During this period, you must treat the product and packaging with care. You will only unpack or use the product to the extent necessary to assess whether you wish to keep the product.

Goods must be returned within the same time limit, in their original packaging, undamaged, accompanied by all accessories, the user manual and a (copy) of the invoice/delivery note. For reasons of hygiene, the return of underwear is not accepted.

Sale products :

Products on sale cannot be returned or exchanged.



Article 6 - Returns for defects

Should you receive a defective product despite the care taken in shipping the products, you may return it to us at any time. You may return it to us for exchange. To do so, please follow the above-mentioned return procedure.


 

Article 7 - Warranty and liability

You benefit from the legal guarantees against hidden defects.

Despite all the care taken with your order, we cannot be held liable in the event of failure to meet our contractual obligations due to an act of God or force majeure. We cannot be held liable in the event of our suppliers being out of stock.

Photos, texts, pictograms (including pictograms indicating the country of manufacture of the product), appearing in our catalogs, prospectuses and other commercial documents or attached to offers are for information purposes only and do not constitute any commitment, unless otherwise agreed in writing. We reserve the right to modify the presentation and/or characteristics of our equipment in the interests of improvement and customer service.


Article 8 - Ownership

Unless otherwise agreed in writing between the parties, we remain the sole owners of the intellectual property rights to our literary creations, drawings, trademarks and graphic or audiovisual productions, whatever the medium, subject to the provisions of the French Intellectual Property Code.

 

Article 9 - Personal data

The information and data concerning you are necessary for the management of your order and for our commercial relations. The data is stored in your personal account by eP Sprl: this data allows us to complete your transaction. In addition, this data, once saved, allows you to carry out future transactions more quickly.


We undertake not to divulge or market any information whatsoever concerning you.

You have the right to object at any time, free of charge and on simple request, to the processing of your personal data for direct marketing purposes. You also have the right to object, free of charge, to the use of your e-mail address for direct marketing purposes. You can exercise these rights by sending an e-mail to contact@hopono-shop.com or by post to the address below.

In accordance with the RGPD law, you can request your personal data collected by Hopono, as well as their deletion. This information is available in your customer area “My account” in the tab “My personal data”.

 

If you have placed an order with “guest” status, without creating an account, you do not have access to a “Customer account” space. In this case, simply send us an e-mail to contact@hopono-shop.com so that we can send you your data or delete it.
